Adjuntamos declaración del Comité Oscar Romero - SICSAL - Chile, en relación a la demanda boliviana de salida al mar. Se trata de algunos antecedentes a tener presentes en el necesario discernimiento ético de los cristianos y de las personas de buena voluntad respecto de esta situación que debe ser resuelta racionalmente. FE CRISTIANA, MAR SOBERANO Y SOBERANIA DE LAS FINANZAS.

- Reflexión en torno a la petición de soberanía marítima de Bolivia.

 

 

I.   El Presidente del Estado  Plurinacional de Bolivia, Evo Morales, ha decidido presentar una demanda ante la Corte Internacional de Justicia para que su país pueda “retornar al mar con soberanía”, afirmando que el Tratado Americano de Soluciones Pacíficas (Pacto de Bogotá) está en vigor en las relaciones ante el Estado Plurinacional de Bolivia y la República de Chile y así cambiar la situación establecida por el Tratado de Paz, Amistad y Comercio, firmado entre ambas naciones el 20 de octubre de 1904.  Dicho Tratado de 1904 pretendía resolver el diferendo limítrofe producido tras la Guerra del Pacífico, siendo insatisfactorio para Bolivia.

 

II.   El Estado de Chile, en reiteradas oportunidades, ha reconocido que el diferendo con Bolivia no ha sido resuelto en su globalidad.  Dicho reconocimiento está implícito en el Tratado de 1929 con Perú, que incluye una cláusula que obliga a que una salida soberana al mar para Bolivia por territorios que antes fueron peruanos, debe incluir a Perú en la negociación.

 

III.  El Estado chileno y un significativo porcentaje de la población afirman que “nuestros derechos nacen de la victoria de la Guerra del Pacífico”.  Este argumento tiene su origen en la teoría de la “guerra justa”, concepción medieval que legitimaba moralmente la guerra, aunque bajo los criterios de justa causa, legítima autoridad, probabilidad de éxito, proporcionalidad y respeto de los no combatientes.

Los hechos de la historia nos indican que la Guerra del Pacífico (en la que Bolivia perdió su soberanía marítima), no constituyó una “guerra justa”, sino una guerra de agresión de parte de Chile: se incorporaron al mapa chileno los desiertos de Atacama y Tarapacá.  Perú perdió el salitre y las guaneras.  Bolivia perdió la salida al mar.

El verdadero vencedor fue el británico John Thomas North, convertido en el rey del salitre tras la compra de bonos reconocidos como legítimos por el Estado chileno.

 

IV.  En la actualidad, la opción autónoma de la guerra es considerada ilegal a partir del Pacto Briand-Kellog de 1928 y es catalogado un crimen desde el juicio internacional de Nüremberg de 1946, que  tipificó como “crimen contra la paz planear, preparar, iniciar o desencadenar una guerra de agresión o una guerra en transgresión de tratados, acuerdos o garantías internacionales”.

 

V. Las malas relaciones de Chile no sólo con Bolivia, sino también con Perú y Argentina, han condicionado sus relaciones exteriores y han conducido a las Fuerzas Armadas como protagonistas influyentes en el sistema político y social, reforzando la mentalidad autoritaria, belicista, clasista y racista, presente en el servicio militar, el sistema escolar y los medios de comunicación social.

 

VI.  En el presente contexto, cultural e históricamente complejo, las Iglesias y todos los discípulos de Jesucristo debemos tener presente que un nacionalismo exacerbado es una actitud nociva.   “La “tranquilidad en el orden”, según la definición agustiniana de la paz, no es pasividad ni conformismo.  No es, tampoco, algo que se adquiera una vez por todas; es el resultado de un continuo esfuerzo de adaptación a las nuevas circunstancias, a las exigencias y desafíos de una historia cambiante.  Una paz estática y aparente puede obtenerse con el empleo de la fuerza; una paz auténtica implica lucha, capacidad inventiva, conquista permanente”.  (IIª Conferencia General del Episcopado Latinoamericano, Medellín, 1968, Nº 14).

 

VII.  Siendo el cristiano “un artesano de la paz” y siendo la paz fruto de la justicia, en este momento crucial de la historia instamos a la oración y al razonamiento para encontrar solución al legítimo derecho del pueblo boliviano de acceso soberano al mar.

La soberanía de una nación no es solo territorial, sino que comprende muchos otros ámbitos.  Es, por tanto, válido preguntar a las autoridades de Chile por la realidad del ejercicio soberano del pueblo, de quien se suponen emanados todos los poderes del Estado, respecto de la privatización del cobre, del agua, de los servicios básicos, de la flora y fauna marinas, de la previsión, de la salud, de la educación, de los medios de comunicación de masas, de la distribución de alimentos, de la producción industrial, etc…, etc…, etc…

 

VIII.  Las injusticias, las desigualdades económicas y sociales, el orgullo, la discriminación, la exclusión, son amenazas de la paz entre los hombres y las naciones.

De parte de las autoridades y de los cristianos esperamos  buena voluntad, de tal manera que se haga realidad la Palabra de Dios: “De sus espadas forjarán arados y de sus lanzas podaderas.  Ninguna nación levantará ya más la espada contra otra y no se adiestrarán más para el combate”.  (Is. 2,4).
