Las decisiones sobre los pueblos exigen ser consultadas.-

 

Sobre la objeción preliminar a la jurisdicción de la Corte Internacional de Justicia (CIJ) respecto de la presentación efectuada por Bolivia en torno al requerimiento de diálogo con Chile para buscar solución al enclaustramiento marítimo de este país, el Comité Oscar Romero-SICSAL-Chile quiere contribuir a la reflexión y a la paz de las naciones, haciendo presente lo siguiente:

 

I El actual conflicto por la salida soberana al mar de parte de Bolivia tiene su origen en el siglo XIX , producto de múltiples situaciones entre sectores poderosos que desembocaron en la Guerra del Pacífico, enfrentándose Chile con Perú y Bolivia, en medio de un patriotismo irracional.

La élite chilena de entonces había acomodado sus intereses extendiendo sus capitales y trabajadores hacia la costa salitrera peruana y boliviana.  Dicha expansión constituyó uno de los factores que condujo a la guerra.  La victoria chilena en aquel conflicto bélico incidió en el crecimiento económico y el lujo ostentoso de la oligarquía, lo que permitió evitar los efectos de la recesión internacional de 1873, al convertirse Chile en el único productor mundial de salitre. 

Sin embargo, ello no significó un cambio en las deplorables condiciones de vida de los sectores populares.

 

II El actual gobierno de Chile ha objetado la jurisdicción de la Corte de La Haya bajo el argumento de que la demanda boliviana buscaría afecta lo ya resuelto por el Tratado de 1904, que estableció los límites de ambos países.  En consecuencia, la presente demanda boliviana estaría excluida de la competencia de la corte porque el artículo VI del Pacto de Bogotá excluiría expresamente demandas de tales objetivos.

 

III Se encuentra internalizado en la cultura chilena que, en relación a la salida al mar de Bolivia “no hay nada que discutir”, en base a la supuesta legitimidad del “derecho de conquista” patrimonio irrenunciable y herencia de sangre derramada.  En esas circunstancias, Bolivia perdió 120.000 Km2 de territorio terrestre y 400 Km. de costa marítima soberana sobre el Océano Pacífico.

 

IV Bolivia pide que la Corte declare que Chile tiene la obligación de negociar de buena fe un acuerdo pronto y efectivo que le dé una salida soberana al Océano Pacífico, lo cual no se basa en el Tratado de 1904.  Por su parte, la Convención de la ONU sobre el Derecho del Mar de 1982 establece que el mar es un bien común de toda la humanidad y que ningún país puede ser privado del libre acceso a este bien común, que no es susceptibles apropiación particular por ningún Estado.  Chile adhirió a esta convención multilateral el 25 de agosto de 1997 y Bolivia el 28 de abril de 1995, siéndole obligatoria a ambos países.

 

V Como constructores de la paz, que es fruto de la justicia, e interpelados por las Bienaventuranzas del Jesús, los integrantes del comité Oscar Romero-SICSAL-Chile consideramos:

1º la demanda boliviana por una salida soberana al mar es éticamente válida y el Estado de Chile debe acceder al diálogo para darle solución.  Es absurdo y pueril negarse a la existencia de un conflicto con Bolivia.

2º Tanto la dictadura militar chilena como los gobiernos que le han sucedido, han mostrado una actitud de soberbia y de torpeza frente a los países de América Latina.  Ello es contradictorio con la política económica de apertura a los mercados y las facilidades otorgadas a las empresas multinacionales.

3º Anteriormente, Chile accedió a un litigio con Perú en La Haya.  Es fácil suponer que dicha disposición se haya debido a las inversiones de capitales de empresarios chilenos en este país.  Es dable pensar que con Bolivia se exhibe una actitud distinta por la inexistencia de grupos económicos chilenos en el país altiplánico.

4º Como Pueblo de Dios, constituye nuestro deber pensar en América Latina en forma global y negar la ingerencia  de grandes potencias que atizan enemistades entre las naciones pobres con perspectivas belicistas y de explotación económica.

5º Las decisiones que afecta a los pueblos deben ser consultadas a los pueblos.  No es legítimo que en asuntos trascendentales sean sólo gobernantes y los grupos económicos quienes tengan capacidad de decisión.  Es vital la consulta a los pueblos para que las decisiones sean efectivas y duraderas, de tal manera que no se modifiquen por las correlaciones de fuerzas temporales.

6º Si Chile habla del respeto e intangibilidad de los tratados, significa que no puede salirse del Pacto de Bogotá para no abordar la solución definitiva de los efectos de la Guerra del Pacífico.  De ser así, Chile no podría continuar como miembro no permanente del Consejo de Seguridad de la ONU:

7º Instamos todas las Iglesias y a los hombres de buena voluntad a crear condiciones de posibilidad para la solución del conflicto.  El silencio es una forma de profundización del problema.

Si Chile se niega al diálogo por una salida al mar de Bolivia: ¿acudirá, entonces, a una acción bélica, aumentando los presupuestos militares en mayor detrimento del pueblo?  ¿Continuará Chile importando carbón y gas desde otros continentes, en circunstancias que puede traerlo desde Bolivia?  ¿Por qué no se puede convertir a Arica en territorio internacional, lo que además contribuiría a superar su decadencia?  NO se puede olvidar que el 70% de la carga del puerto de Arica es boliviana y en Iquique es del 49%.

 

VI Es también válido preguntarse por la negativa la diálogo con Bolivia por un tramo de territorio soberano, no obstante Chile ha entregado a empresas particulares la explotación de los recursos marítimos, dejando a los pescadores artesanales en “proceso de extinción”, así como también se han privatizado los 57 puertos a lo largo de los cuatro mil Km. de costa.  Pareciera que lo que originó la Guerra del Pacífico se reitera en la actualidad.

Instamos a la reflexión, pues estamos convencidos que “como la tierra echa sus brotes, como un huerto hace brotar lo sembrado, así el Señor Yavé hará germinar la justicia y la gloria ante todas las naciones”.  (Is. 61, 11).
