POR EL FIN DE LA TORTURA.-

Desde su fundación, en marzo de 2001, la  Comisión Etica contra la Tortura (CECT-Chile) ha conmemorado el 26 de junio, instaurado por la ONU como el Día Internacional de Apoyo a las Víctimas de la Tortura

El Informe de la Comisión de Verdad y Reconciliación de 1991 asumió los casos de desapariciones forzadas y de ejecuciones políticas a manos de aparatos de seguridad de la dictadura militar.  Dejó fuera de su competencia otros atropellos, tales como el exilio, la relegación y la tortura.

La Comisión Etica contra la Tortura se formó para exigir verdad, justicia y reparación al Estado de Chile para los sobrevivientes de tortura de la dictadura militar.  El 3 de agosto de 2003, el entonces Presidente de la República dio a conocer la constitución de la Comisión Nacional sobre Prisión Política y Tortura, la que mantuvo su funcionamiento por dos períodos de atención a las víctimas.

La CECT ha considerado su necesaria permanencia en el tiempo, debido a la ausencia de un Plan Nacional de Derechos Humanos y a la insuficiencia de las medidas adoptadas por el Estado de Chile, por lo que ha basado su actuar bajo los principios de la Convención Internacional contra la Tortura y otros Tratos Crueles, Inhumanos y Degradantes, con el objetivo de terminar con el delito de tortura en Chile, cuya  práctica ha continuado hasta el presente.  Manifestación de ello es la huelga de hambre llevada adelante por ex presos políticos abandonados a su suerte.

La CECT se ha dirigido reiteradamente a los organismos internacionales y del Estado chileno en aras de la erradicación de tortura, solicitando la adopción y/o promoción de medidas que permitirían la prevención y sanción de la tortura y que responden a los compromisos del Estado de Chile en esta materia tras las recomendaciones de la ONU al respecto.

Entre los principales planteamientos de la CECT  se encuentran los siguientes:

1º Implementación del Mecanismo Nacional de Prevención de la Tortura y nombramiento de la Comisión Nacional de Prevención de la Tortura, puesto que desde febrero de 2010, Chile debió crear una o varias instancias para la prevención de la tortura, instancia derivada de la ratificación realizada por Chile del Protocolo Facultativo a la Convención Internacional contra la Tortura y otros Tratos o Penas Crueles, Inhumanos o Degradantes, bajo el decreto 340 del 14 de febrero de 2009.  Dicha entidad debe ser autónoma, con presupuesto propio, fuertemente arraigada en la sociedad civil, constituida por personas de reconocida solvencia moral, con atribuciones para presentarse –sin necesidad de autorización ni aviso- en cualquier unidad de detención legal del país.  Una institución de este tipo tendría enorme utilidad para prevenir y disuadir prácticas de torturas o malos tratos que se hicieren sin conocimiento de las autoridades.

2º Derogación de la disposición de la Ley de Reparaciones Nº 19.992, que facilita la impunidad de las torturas cometidas durante la dictadura militar.  La Ley de Reparaciones aprobada en diciembre de 2004, contiene en su artículo 15 dos disposiciones destinadas a impedir la justicia en dichos casos: la prohibición para que los Tribunales de Justicia puedan acceder a los testimonios de torturas aportados por las víctimas a la Comisión Nacional sobre Prisión Política y Tortura; y el establecimiento de 50 años de secreto para dichos testimonios.

Estas disposiciones facilitan la impunidad de la tortura, significan un grave atentado a la potestad y autonomía del Poder Judicial al vulnerar la Constitución y los tratados  de los que Chile es Estado Parte.  Además, se transgrede el principio de oficialidad, que significa que los Tribunales, sin necesidad de requerimiento alguno, al tomar conocimiento de hechos que puedan revestir caracteres de delito, deben instruir el sumario correspondiente.

3º Derogación de la Ley Antiterrorista o, al menos, de sus disposiciones más violatorias de derechos humanos más fundamentales.

La Ley 18.314, Ley de Conductas Terroristas (conocida como Ley Antiterrorista), promulgada en 1984 por la dictadura militar, establece tipos penales muy amplios, que posibilitan su aplicación a hechos que nada tienen que ver con terrorismo y que pueden ser juzgados y sancionados por la legislación penal ordinaria.  Con dicha ley, la dictadura pretendía desarticular los grupos organizados.

4º Derogación del DL de Amnistía Nº 2191 de 1978, que obstaculiza la posibilidad de sancionar los crímenes de tortura y otros cometidos entre el 11 de septiembre de 1973 y el 10 de marzo de 1978.

5º Poner término al envío de soldados y policías a la Escuela de las Américas y cierre del “Centro de Entrenamiento para Operaciones de Paz” que opera en la base militar del Fuerte Aguayo en Con-Cón y que es financiada por el Comando Sur del Ejército de Estados Unidos.

6º Derogación de las disposiciones legales y reglamentarias que establecen “obediencia debida” a los cuerpos armados, porque su mantención favorece la aplicación de tortura.

7º Inhabilidad permanente para ocupar cargos públicos para todos los violadores de derechos humanos.

8º Término de la Justicia Militar para juzgar a civiles.

9º Atender a las demandas de los pueblos originarios, en relación al derecho a la tierra, al reconocimiento constitucional, al fomento de sus lenguas, a la protección del medio y de los recursos naturales de sus territorios.  En el caso particular del pueblo mapuche, se debe proceder a la desmilitarización de su territorio, de acuerdo al Convenio 169 de la OIT, ratificado por Chile el 15 de septiembre de 2008, y la Declaración de la ONU sobre los Derechos de los Pueblos Indígenas, aprobada el 13 de septiembre de 2007 por la Asamblea General de la ONU.

10º constitución de una entidad permanente y autónoma del Estado, que acoja las denuncias de violaciones de derechos humanos de parte de agentes y/o instituciones oficiales, con facultades legales para gestionar la búsqueda de justicia y reparación ante los tribunales pertinentes.

11º Legislar en torno a los derechos y deberes de la población penal.

La Comisión Etica contra la Tortura (CECT-Chile) considera que estas medidas contribuirían a erradicar la tortura, a fomentar el respeto del conjunto de los derechos humanos fundamentales y al debido cumplimiento de los compromisos internacionales de Chile en esta materia.
