TRIBUNAL CONDENA A RIOS MONTT POR GENOCIDIO Y DELITOS CONTRA LOS DEBERES DE HUMANIDAD Y ABSUELVE A SU ENCARGADO DE INTELIGENCIA

 

El honorable Tribunal de Sentencia condenó a 80 años de prisión por los delitos de genocidio y delitos contra los deberes de humanidad contra el pueblo maya Ixil, al general José Efraín Ríos Montt, después de veintisiete audiencias y diversos intentos por detener el proceso.

A treinta años de ocurridos los hechos y más de diez de haber puesto la denuncia, por los sobrevivientes y víctimas del genocidio, el Sistema de Justicia de Guatemala, confirma lo que se ha denunciado durante este tiempo y además reconoce que dichos delitos de lesa humanidad deben ser castigados para garantizar que NUNCA MÁS SE VUELVAN A COMETER.

Resaltamos que la sentencia toma en cuenta los peritajes sobre racismo y genocidio, psicosocial, militar, antropológicos, cultural, de violencia sexual, y estadístico, aportados por el Ministerio Publico. Así como la prueba documental contenida en el Plan Victoria 82, Plan Firmeza 83 y Plan de Operaciones Sofía, en los cuales se evidencia que el ejército estigmatizó de rebelde, subversivo al pueblo Ixil por lo tanto entraba en la categoría de enemigo interno, por lo que debía ser eliminado.

El Plan Firmeza 83 estableció que se arrasara a las poblaciones y destruyera sus posesiones y en el plan de operaciones Sofía la estrategia era propiciar y mantener el hambre para exterminar al pueblo ixil y destruir sus costumbres y cultura. La Jueza Barrios constató que: “los juzgadores hemos podido constatar mediante los testimonio la muerte violenta de las personas, incendio de viviendas, muerte sistemática de niños y ancianos en forma indiscriminada.”

Un elemento importante a resaltar es que la sentencia toma en cuenta la violencia sexual vivida por las mujeres en el área Ixil y cómo este delito buscaba evitar la reproducción del pueblo Ixil. La tortura, dolor y terror, afectaron su desarrollo físico y emocional, daño que aún se encuentra vigente y han afectado a los hijos de las víctimas.

El Tribunal constató que hubo la intencionalidad de eliminar al grupo étnico maya Ixil. Siendo el racismo la base para el genocidio. Se violaron principios de derecho internacional humanitaria ocasionaron daños innecesarios. Mediante los documento militares se comprobó que los documentos Victoria 82 y Firmeza 83 con finalidad de destruir a aquellos que se consideran enemigos, y una de las acciones era cambiar la mente de las personas y control de la población.

También la sentencia hace referencia al peritaje del general José Luis Quilo Ayuso quien confirmó que el general Ríos Montt tenía mando y conocimiento de lo que ocurría. Los hechos fueron planificados y luego ejecutados, hechos que fueron comprobados con los testimonios.

El Tribunal estimó que existe duda de la participación que pudo tener el general José Rodríguez Sánchez por lo absuelve de los cargos de genocidio y delitos de lesa humanidad. Dicho general quedará en prisión preventiva hasta que su sentencia quede firme.

Reconocemos el trabajo realizado por el Ministerio Público y jueces y magistrados que han actuado apegado a derecho durante el proceso, en especial al Tribunal de Sentencia de Mayor Riesgo “A” integrado por las honorables Juezas y Juez: Iris Jassmin Barrios Aguilar, Patricia Isabel Bustamante García y Pablo Xitumul de Paz, serán recordados como los jueces que le dieron la oportunidad al país de resignificar su historia. Pero también denunciamos a aquellos jueces y magistrados que en este proceso han quedado evidenciados como los hombres y mujeres que se prestaron al juego de la impunidad, la historia ha escrito sus nombres y serán recordados por eso, frente al pueblo de Guatemala y al mundo entero.

La sentencia se dicta en un día en que el Sagrado Calendario Maya está regido por la fuerza del Nawual AJPU, que representa al Abuelo Sol, un día de discernimiento y asertividad que se consiguen mediante la observación de lo ocurrido. Hoy con esta sentencia se da la oportunidad para un nuevo amanecer, un nuevo sol, una oportunidad para construir un país más justo.
