Los abajo firmantes, observadores y defensores de derechos humanos pertenecientes a las organizaciones Comisión Ética Contra la Tortura y Coordinadora 4 de Agosto por la Defensa de los Derechos del Pueblo, tras imponerse de la ocupación de comuneros Mapuche-Pewenche de Cauñicú (Comuna de Alto BíoBío, VIII Región) de un territorio ubicado en el sector Los Cheques, declaran a las autoridades del Estado de Chile y la opinión pública nacional e internacional lo siguiente:

1.- La ocupación del territorio mencionado es reivindicada como Territorio ancestral por la comunidad pewenche de Cauñicú, de acuerdo a lo señalado por el vocero Nelson Maripil. Por su parte, según el testimonio del Lonco de la comunidad Marcelino Queupil, en dicho territorio se encuentran importantes hitos que dan cuenta de la presencia pewenche representada en la existencia de cementerios, nguillatuwe y paliwe anteriores a la categoría de propiedad privada que el territorio ostenta en la actualidad. Dicha demanda tiene correspondencia con el artículo 14, N° 1, del Convenio 169 de la OIT, en el que se señala que deberá reconocerse para los pueblos indígenas el derecho de propiedad y de posesión sobre las tierras que tradicionalmente ocupan.La Declaración de Naciones Unidas sobre los Derechos de los Pueblos Indígenas se expresa con una mayor precisión cuando en su artículo 26, N° 1, establece que los pueblos indígenas “tienen derecho a las tierras, territorios y recursos que tradicionalmente han poseído, ocupado o utilizado o adquirido”. Ambos instrumentos jurídicos ratificados por el Estado de Chile.

2.- La responsabilidad de la comunidad involucrada en la acción de recuperación territorial, se enmarca en la obediencia colectiva a una consciencia distinta de la occidental, que determina a la comunidad en su actuar y no le permite representarse su acción como delito. En este sentido, es convicción de los comuneros pewenche estar recuperando tierras que anteriormente habían ocupado y, por tanto, no consideran estar incurriendo en una ilegalidad. Este planteamiento se sustenta en el artículo 13, N° 1, del Convenio 169 de la OIT al afirmar “la importancia especial que para las culturas y valores espirituales de los pueblos interesados reviste su relación con las tierras o territorios”.

3.- Hacemos un llamado a las autoridades del Estado de Chile a garantizar el respeto a la vida e integridad física y psíquica de las personas que se encuentran al interior de la propiedad aludida, con particular preocupación por la presencia de niños y niñas junto a sus padres y familiares. Durante los últimos meses la opinión pública ha conocido hechos de violencia que han afectado gravemente a comuneros mapuche. Nos referimos particularmente a los lamentables sucesos acontecidos el día 10 de febrero del presente año en el Lob Choque- LleuLleu, en el que nueve personas fueron detenidas y testimoniaron agresiones aberrantes por agentes del Estado, que se han difundido a través de las redes sociales y han sido denunciados ante el Instituto Nacional de Derechos Humanos.
